These Terms of Service (“Terms”) govern your access to and use of the Work Pilot website, applications, and services (collectively, the “Services”). Work Pilot is operated by 1000896240 ONTARIO INC.
By accessing or using the Services, you agree to be bound by these Terms.
1. Eligibility
You must be at least 18 years old and capable of entering into legally binding agreements to use the Services.
2. Services
Work Pilot provides contractor-focused workflow management and CRM software, including features such as project management, invoicing, quoting, messaging, milestone tracking, file storage, and related tools.
We may modify, suspend, or discontinue portions of the Services at any time without liability.
3. Accounts
You are responsible for:
- Maintaining account confidentiality
- Ensuring information provided is accurate
- All activity under your account
You must promptly notify us of any unauthorized access or security concerns.
4. Subscription Billing
Certain features require a paid subscription.
By subscribing, you authorize recurring billing through our payment processor.
Billing Terms
- Subscriptions may be billed monthly or annually
- Fees are charged in advance
- Prices may change with reasonable notice
Cancellation
You may cancel your subscription at any time. Cancellation prevents future billing but does not automatically generate refunds for previously paid periods unless required by law.
5. Free Trials
We may offer free trials for certain subscription plans. At the conclusion of the trial period, access may be limited unless a paid subscription is activated.
6. Acceptable Use
You agree not to:
- Use the Services for unlawful purposes
- Upload malicious software or harmful content
- Attempt unauthorized access to systems or accounts
- Interfere with platform operation
- Use the Services to infringe intellectual property rights
- Upload content you do not have rights to use
7. User Content
You retain ownership of content uploaded to the Services.
You grant Work Pilot a limited, non-exclusive license to host, process, store, and display content solely for providing the Services.
8. Intellectual Property
The Services, including software, branding, designs, logos, and content created by Work Pilot, are owned by or licensed to Work Pilot and protected under applicable intellectual property laws.
You may not copy, reverse engineer, distribute, or exploit the Services except as permitted by law.
9. Third-Party Services
The Services may integrate with third-party providers. We are not responsible for third-party services, content, or policies.
10. Availability
We strive to maintain reliable Services but do not guarantee uninterrupted or error-free operation.
Maintenance, outages, or technical issues may occur.
11. Disclaimer
The Services are provided “as is” and “as available” without warranties of any kind, whether express or implied.
To the maximum extent permitted by law, we disclaim all warranties, including merchantability, fitness for a particular purpose, and non-infringement.
12. Limitation of Liability
To the maximum extent permitted by law, Work Pilot and 1000896240 ONTARIO INC. shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the Services.
Our total liability shall not exceed the amount paid by you to Work Pilot in the twelve (12) months preceding the claim.
13. Indemnification
You agree to indemnify and hold harmless Work Pilot and 1000896240 ONTARIO INC. from claims, damages, liabilities, and expenses arising from:
- Your use of the Services
- Your content
- Your violation of these Terms
14. Termination
We may suspend or terminate accounts that violate these Terms or create risk to the platform or other users.
15. Governing Law
These Terms shall be governed by the laws of the Province of Ontario and the applicable laws of Canada.
16. Changes to These Terms
We may update these Terms periodically. Continued use of the Services after changes constitutes acceptance of the updated Terms.
